The strike …. How will it work?

The CSN along with other labor organizations challenged the Essential services regulation that established uniform strike time percentages for all hospital departments and job titles.

In 2015, under the old law, our strike time in a hospital was 10% of the workday. or 42 minutes.

The Courts have declared this law unconstitutional.  The new law has two major changes.

1) The amount of strike time allowed to keep essential services varies by department or service

2) Hospital managers will have to work to replace the strikers which allows us to increase our number of people on strike at the same time.

Below we publish two recent decisions rendered by the Administrative Labour Court.  

– The first one is for category 2 (paratechnical, auxiliary and trade services)

– The second is for category 3 (clerical, technical and administrative professionals)

At the end of each of these decisions you will find a table indicating the amount of time required by department to provide essential services.  For example, if the table indicates 60% for your service, this means that you must work 60% of the time during a strike day and therefore, you will be on strike 40% of the time each strike day.

The strike is our only chance to put pressure on the government not to treat us like dirt.  Our work is so essential that the government has even designated us as “guardian angels” of the population.

Beyond compliments, we demand major salary increases Mr. Legault.  Your current offers will only make us poorer for another 3 years.  We, the small wage earners in the health care network, have not even kept up with inflation since 2004.  Enough is enough!

NOTE THAT EVEN IF THE DECISION CONCERNS A UNION IN THE OUTAOUAIS, THE COURT APPLIES THE SAME REASONING AND THEREFORE THE SAME DECISION FOR THE ENTIRE HEALTH CARE NETWORK
